Circular of Ministry of Foreign Trade and Economic Cooperation, State Press and Publishing Administration and Customs General Administration on the Administration of Imports of CD Manufacturing Equipment

In accordance with circular of Further Strengthening the Administration
of CD Reproduction which was jointly issued by seven departments, namely the Propaganda
Department of the Central Committee of the Communist Party of China, the State Press and
Publishing Administration ( hereinafter referred to as SPPA ), the State Planning
Commission, the Ministry of Foreign Trade and Economic Cooperation ( hereinafter referred
to as MOFTEC ), the Customs General Administration, the State Administration for Industry
and Commerce and the State Copyright Administration, the relevant issues pertaining to the
administration of imports of CD manufacturing equipment are hereby noticed as follows:
1. The CD manufacturing equipment specified in this circular refers to
the processing and manufacturing equipment for master-disk carving, recording and
duplicate-disk reproduction for CD-DA, CD-V, V-CD, CD-ROM, CD-I, CD-G, PHOTO-CD, CD-R,
CD-MO, DVD, LD and so on. The detailed tariff codes for the equipment are the following:
2. The enterprises which import the above stated equipment in the way
of general trade or processing trade, shall first apply to SPPA, once approved, shall then
apply for import license from the Quotas and License Bureau of MOFTEC, presenting the
approval document of SPPA and the registration form for imports of machinery and
electronics issued by the department in charge of examination of such imports. The Customs
shall examine and release the above-listed equipment according to the import license.
3. The foreign-funded enterprises engaged in CD production which import
the above stated equipment, shall apply to the Quotas and License Bureau of MOFTEC for
import license, by presenting the operation license of reproducing audio-video products
form SPPA, approval document from MOFTEC and the list of imports of the equipment approved
by MOFTEC. The Customs shall examine and release the above-listed equipment according to
the import license.
4. Any import of the above stated CD manufacturing equipment which
violates the provisions of this circular shall be dealt with by the Customs in accordance
with the Customs Law.
