President's Directive Regarding The Use
Of Alcoholic Beverages On CampusJuly 18, 1980 (Editorial Amendment: 9/00, 8/01)
- Authority for Issuance.
This directive is issued pursuant to section 23605 of the Education Code; Minutes of the Board of Trustees Meeting, August 4, 1961, page 186; and attachment thereto, page 5.
- Scope of this Directive.
The intent of this directive is neither to encourage nor to endorse the use of alcoholic beverages, but to clarify the use of alcoholic beverages on campus.
- Directive.
This directive prohibits on campus:
a. The sale of alcoholic beverages (except as noted in section 5d).
b. The sale, furnishing, or giving of an alcoholic beverage to any person under 21 years of age.
c. The consumption of alcoholic beverages by a person under 21 years of age.
d. The consumption of alcoholic beverages by persons 21 years of age or older, except as designated below.
- Designation.
Alcoholic beverages may be consumed on campus by persons 21 years of age or older only at group-sponsored events at locations specified by the President and subject to the procedures and restrictions outlined below; or in premises where onsite sales are authorized by a license issued by the Department of Alcoholic Beverage Control.
- Restrictions. Written permission by the Associate Vice President for Administration or designee to use alcoholic beverages at group-sponsored events shall be subject to the following restrictions.
a. Attendance shall be limited to members of the sponsoring organizations and their invited guests.
b. The event shall not be open to the public or the university community generally and shall not be advertised or publicized generally or to the university community as an event where alcoholic beverages are to be served.
c. The chair of the event and the sponsoring organization are both responsible for compliance with applicable laws, regulations, university policies and this directive. No person under 21 years of age shall be in attendance, and no such person nor any obviously intoxicated person shall be furnished, serve, or given an alcoholic beverage.
d. Except for licensed, on-premises beer and wine sales in the University Student Union, and in the University Club, there shall be no sale of alcoholic beverages. Certain catering-related sales in specified locations for beer and wine only, under limited license regulations, are permissible only within the framework of this directive. The term "sale" means the exchanging of any consideration, either directly or indirectly, for an alcoholic beverage. The term "sale" also includes the imposition of an admission charge to, or any other charge for, the event at which alcoholic beverages will be served exclusively to those who pay such charge. The term "consideration," as used above, includes money or tickets, tokens or chits which have been issued in exchange for money or anything else of value.
e. The sponsoring organization shall cease serving alcoholic beverages at the request of an appropriate university official. "Appropriate university official" as used in this section shall include a campus police officer, the Associate Vice President for Administration or designee, or the Foundation Food Services Director or designees. In addition, the President, Vice President, and deans shall exercise this authority should the occasion require it.
f. Except within licensed premises, there shall be no service of alcoholic beverages prior to 4:00 p.m. through Thursday. Service shall be permissible no earlier than 11:30 a.m. on Friday, Saturday, and Sunday.
- Procedures.
a. Applications.
- Colleges, divisions, departments/divisions/schools, student organizations and other recognized faculty or staff organizations, as well as off-campus organizations sponsored by on-campus organizations, may request permission to hold a group-sponsored event at which alcoholic beverages may be served by submitting an application to the University's Central Reservations Office no later than 10 university working days prior to the proposed event. Groups con ducting events in the University Club shall make their applications directly to the Foundation Food Services Director. Approval for such events shall be obtained by the Food Services Director from the Director of the University Student Union. The source of funds to pay for any alcoholic beverage to be served at the pro posed group-sponsored event shall be included in the request. The request shall also affirm that payment of an admission charge to the event is not a precondition of being served alcoholic beverages at the event, as set forth in section 5 of this directive. Application forms are available at the Central Reservations Office in the University Student Union.
- Established procedures for reserving university facilities shall be followed in addition to this special procedure regarding the serving of alcoholic beverages.
b. Appeal of Denial of Application.
Faculty organizations may appeal a negative decision by the Associate Vice President for Administration or designee by applying in writing to the Vice President for Academic Affairs. Staff organizations may appeal a negative decision by applying in writing to the Vice President for Administration. Student organizations may appeal a negative decision by applying in writing to the Dean of Students.
- Penalty for Non-Compliance.
Failure of an organization to comply with this directive may, after notice and hearing, result in disciplinary action against the organization, including probation, suspension, or forfeiture of rights and privileges as a recognized campus organization pursuant to procedures established regarding the violation of campus policies, procedures, or regulations by recognized campus organizations. Failure to comply with this directive after notice and hearing may result in the denial of future use of university facilities to any sponsoring organization if such action is deemed appropriate by the Associate Vice President for Administration or either of the Vice Presidents.
- Appeal of Penalty for Non-Compliance.
Appeals from disciplinary decisions made under section 7 of this directive shall be made to the President.
